Terms of Service

These Terms of Service ("Terms") govern your use of mercatoros.com and the creditOS Shopify application ("Service"), operated by mercatorOS. By using the Service, you agree to these Terms.
Use of the Service
creditOS is a Shopify application. You must have a valid Shopify account to use it. You are responsible for maintaining the security of your Shopify account and for all activity under that account.
You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Service to violate any applicable law or regulation
- Attempt to gain unauthorised access to any part of the Service
- Reverse-engineer, decompile, or extract source code from the Service
- Resell or sublicense the Service without our written consent
Subscriptions and Billing
creditOS is available on a subscription basis, billed through the Shopify Billing API. Charges appear on your Shopify invoice.
Free trial: New subscribers receive a 30-day free trial with full access to Growth plan features. No credit card is required to start a trial. Trials are available once per Shopify store.
Billing cycle: Subscriptions are billed monthly or annually depending on the plan selected. Annual plans are billed upfront.
Price changes: We will provide at least 30 days notice before increasing subscription prices.
Cancellation
You may cancel your subscription at any time from the Shopify App Store. Access to the Service continues until the end of your current billing period. We do not provide prorated refunds for partial periods.
Upon cancellation, your creditOS configuration (tier settings, policies) remains stored in your Shopify Metafields. You may reinstall the app at any time.
Data and Privacy
Use of the Service is subject to our Privacy Policy at mercatoros.com/privacy. By using the Service, you consent to data practices described in that policy.
Intellectual Property
The Service, including all software, design, and content, is owned by mercatorOS and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or brand assets.
Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
Credit scoring outputs are algorithmic estimates based on the data available in your Shopify store. They are tools to inform decisions, not financial advice. We are not liable for credit decisions made based on creditOS outputs.
Limitation of Liability
To the maximum extent permitted by law, mercatorOS shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, even if advised of the possibility of such damages.
Our total liability for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid us in the three months preceding the claim.
Modifications to the Service
We reserve the right to modify, suspend, or discontinue any part of the Service with reasonable notice. We will not be liable for any modification, suspension, or discontinuation.
Changes to These Terms
We may update these Terms. We will notify you of material changes via email or an in-app notice. Continued use of the Service after changes take effect constitutes acceptance.
Governing Law
These Terms are governed by the laws of India, without regard to conflict of law principles. Any disputes shall be resolved in the courts of [City], India.
